1. Acceptance of Terms

By accessing or using the Pawdara platform ("Service"), including the website, mobile applications, and clinic portal, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

3. Description of Service

Pawdara provides a digital pet health timeline that connects pet owners with veterinary clinics. Features include pet health record management, vaccination tracking, appointment reminders, document storage, PDF exports, and family sharing.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information during registration and keep it up to date. Pawdara reserves the right to suspend or terminate accounts that violate these terms.

5. Age Requirements

You must be at least 13 years of age to create a pet owner account on Pawdara. You must be at least 18 years of age to create a clinic account. By using the Service, you represent that you meet the applicable age requirement.

6. Subscription & Payments

Pawdara offers free and premium subscription tiers for pet owners, and tiered plans for veterinary clinics. Premium features are available upon payment of the applicable subscription fee. Subscriptions renew automatically unless cancelled before the renewal date.

Subscriptions auto-renew unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing cycle and you retain Premium access until that date. No prorated refunds are issued for unused time. A full refund is available within 48 hours of your first subscription purchase if no Premium features have been used. See our full Refund Policy for details. App store purchases are subject to Apple or Google refund policies.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Upload false, misleading, or fraudulent health records.
• Attempt to access other users' data without authorization.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated systems (bots, scrapers) to access the Service without permission.
• Transmit viruses, malware, or any harmful code.

8. Clinic Responsibilities

Veterinary clinics using Pawdara are responsible for:

• The accuracy of all records uploaded to the platform on behalf of their patients.
• Obtaining appropriate consent from pet owners before linking their accounts.
• Compliance with applicable veterinary regulations and professional standards in their jurisdiction.
• Ensuring only authorized staff members access the clinic portal.

9. Intellectual Property

The Pawdara name, logo, and all related trademarks, service marks, and trade dress are the property of Pawdara. The Pawdara trademark is the subject of pending trademark applications in the United States and Canada. The Service and its content (excluding user-generated content) are protected by copyright, trademark, and other intellectual property laws. You retain ownership of all content you upload to the platform.

10. Data Ownership & Portability

Pet owners retain full ownership of their pet health data. You may export your data at any time using available in-app export features. Export options available depend on your current subscription plan. Upon account deletion, we will remove your personal data within 30 days. Veterinary clinics retain ownership of their clinical notes but grant pet owners read access to non-internal records as facilitated by the platform.

11. Limitation of Liability

To the maximum extent permitted by law, Pawdara shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or damages resulting from reliance on health information displayed on the platform.

Pawdara's total liability for any claims arising under these terms shall not exceed the amount you paid to Pawdara in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Pawdara and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including attorney fees) arising from your use of the Service, violation of these terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.

14. Warranty Disclaimer

The Service is provided on an 'as is' and 'as available' basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Pawdara does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in class action lawsuits against Pawdara. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction.

16. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. To the extent arbitration does not apply, you agree to submit to the personal jurisdiction of the courts located in Delaware.

17. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the revised terms.
